PARKING RESERVATION SERVICE TERMS AND CONDITIONS – MÁLAGA PLAZA SHOPPING CENTER

1. Purpose of the Service

These terms and conditions regulate access to and use of the parking space reservation service offered through the Málaga Plaza Shopping Center website (hereinafter, “the Shopping Center”). Through this service, the user may reserve a parking space for a specific period, subject to availability.

2. Acceptance of the Terms

Use of the service implies full and unconditional acceptance of these terms. The user declares that they have read and understood them before making the reservation.

3. Reservation Process

3.1. To manage a reservation, the user must provide the information requested in the corresponding form.

3.2. Confirmation of the reservation will be sent by email or displayed on the website itself, and will constitute valid proof of the contract.

3.3. Reservations are subject to the availability of spaces at the time of the request.

4. Duration and Use of the Space

4.1. The reservation will guarantee the availability of a parking space exclusively during the time slot selected and paid for by the user. The user must strictly comply with the entry and exit times indicated on the confirmation document.

4.2. The user must respect the indicated entry and exit times. The Shopping Center does not guarantee availability outside the reserved times.

4.3. The use of the parking space is limited to parking the vehicle identified in the reservation, and any other use is prohibited, including expressly the transfer to unauthorized third parties.

4.4. If the user uses the parking facility outside the contracted schedule, they will be required to pay the current general rate for the excess time, which can be consulted in the information tables within the parking facility.

5. Prices and Payments

5.1. The applicable price will be the one indicated on the website at the time of the reservation, including taxes, according to the duration of the service.

5.2. Payment must be made through the methods enabled on the platform.

5.3. The Shopping Center reserves the right to update rates without prior notice, without affecting reservations already confirmed.

6. Modifications and Cancellations

6.1. The user may modify or cancel their reservation whenever the system allows it and within the deadlines established on the website. Cancellation with the right to a refund must be made at least 24 hours before the start time of the reservation.

6.2. In the event of cancellation outside the permitted period or failure of the user to appear, cancellation fees may apply or no refund may be issued.

6.3. The Shopping Center may cancel the reservation due to force majeure, breakdowns, or operational incidents, offering the user an alternative solution or a refund of the amount paid.

7. Parking Usage Rules

7.1. The user must comply with the internal parking rules, signage, speed limits, and instructions from staff.

7.2. Parking vehicles with leaks, dangerous goods, or conditions that compromise safety is prohibited.

7.3. The Shopping Center may remove or immobilize vehicles that violate the rules, in accordance with current legislation.

8. Liability

8.1. The Shopping Center is not responsible for theft, damage, or loss caused to vehicles, except in cases of proven negligence attributable to the Shopping Center.

8.2. The user is responsible for properly locking their vehicle and safeguarding their belongings.

8.3. The Shopping Center will not be responsible for service interruptions resulting from force majeure or technical failures beyond its control.

9. Visible Information, Rates and Regulations

All users will have access, in a clearly visible manner before contracting and within the parking facility itself, to information regarding rates, schedules, conditions, and internal operating rules. Informational signage is available outside the facilities to ensure awareness of these conditions.

10. Personal Data

The data provided will be processed in accordance with the Privacy Policy of the Málaga Plaza Shopping Center and with current data protection regulations.

The user consents to the processing necessary for the management of the reservation and communications related to the service.

11. Intellectual Property

All content on the website, including texts, images, and reservation service operating systems, is the property of the Shopping Center or has the corresponding licenses. Reproduction without authorization is prohibited.

12. Amendments to the Terms

The Shopping Center may update these terms at any time. Modifications will enter into force upon their publication on the website.

13. Applicable Law and Jurisdiction

These terms will be governed by Spanish law. Any dispute arising from the service will be submitted to the Courts and Tribunals of Málaga, unless otherwise provided by law.
